01Our Commitment to Privacy

Tennyson Knapp Consulting (“TKC,” “Company,” “we,” “us,” or “our”) helps businesses improve growth, profitability, leadership, operational performance, and organizational effectiveness. Our services depend on trusted relationships and responsible stewardship of information.

We recognize that information entrusted to us may include confidential business plans, financial information, customer records, professional assessments, employee development information, and other sensitive materials. We are committed to handling such information responsibly, using it for appropriate business purposes, limiting unnecessary access, and implementing safeguards proportionate to its sensitivity.

This Privacy Policy explains the information we collect, how we use it, circumstances in which we disclose it, and choices available to individuals.

02Scope

This policy applies to TKC operated websites, marketing pages, online forms, communications, consulting services, agency services, CRM platforms, AI enabled applications, training programs, and professional development activities. It also applies to TKC operated service brands unless a separate notice identifies another responsible legal entity.

When TKC processes personal information on behalf of a business client, the client's privacy notices and applicable agreements generally determine the authorized purposes of that processing.

  • Transaction information: Service orders, subscriptions, invoices, payments, and billing records.
  • Information from permitted external sources: Publicly available professional information, referrals, authorized data providers, and connected applications.

We seek to limit collection to information reasonably necessary for the relevant purpose.

04How We Use Information

We use information to:

  • Respond to inquiries and provide requested information.
  • Evaluate business requirements and recommend services.
  • Deliver consulting, advisory, marketing, training, and technology services.
  • Operate CRM systems, websites, AI applications, and automation workflows.
  • Manage business relationships, appointments, subscriptions, and payments.
  • Provide authorized professional assessments and employee development programs.
  • Prepare reports, insights, recommendations, and training materials.
  • Monitor quality, security, compliance, and service performance.
  • Facilitate authorized introductions to qualified service partners.
  • Meet applicable legal and contractual obligations.

We may also perform permitted analytics and service improvement activities, subject to applicable confidentiality agreements and privacy requirements.

05Our AI First Approach

TKC uses an AI First operating philosophy to improve service quality, efficiency, responsiveness, and affordability. We evaluate and use artificial intelligence and automation when they can responsibly improve the work performed for our business and clients.

AI technologies may support research, content preparation, analysis, software development, marketing, customer communications, administrative operations, professional development, business reporting, and client service delivery. We may use commercial technologies from providers such as OpenAI, Anthropic, xAI, and other qualified providers. The applicable technology, account configuration, and data handling terms may vary by service.

Where confidential information or personal information is involved, TKC seeks to select appropriate commercial configurations, restrict unnecessary data exposure, and maintain applicable contractual safeguards. We do not authorize unrestricted general model training using confidential client information or identifiable employee development records without appropriate authorization and legal grounds.

AI generated information may be inaccurate or incomplete. Material recommendations and consequential decisions require review appropriate to the risks involved.

06Professional Assessments and Employee Development

TKC may facilitate professional assessments and workforce development programs through authorized assessment, training, coaching, and technology providers. Information may include assessment responses, assessment reports, training completion, development objectives, coaching activities, self reflections, SBI observations, and documented progress.

This information may be used to personalize learning, improve collaboration, support leadership development, identify training opportunities, and evaluate authorized program outcomes. Where applicable, participants will receive additional information explaining the program, the categories of information collected, and who may access those records.

We do not treat behavioral assessments as medical diagnoses or definitive measures of employment suitability. TKC does not independently make fully automated hiring, termination, promotion, compensation, or disciplinary decisions based solely on such information.

07Confidentiality and Information Sharing

TKC may disclose information to employees, authorized contractors, technology providers, and qualified business partners when reasonably necessary for an authorized purpose. Our formal service partners are subject to applicable confidentiality and contractual protections.

Partners may assist with marketing, AI financial software, PEO services, human resources, custom AI, business process automation, leadership development, assessments, and related business solutions. Disclosure will be limited according to the relevant engagement, contractual commitments, applicable law, and the recipient's legitimate need.

When TKC proposes an independent partner introduction, we will obtain the permission required before sharing identifiable information for the partner's own follow up. We may receive referral fees, commissions, or other compensation through certain partner relationships. Material financial relationships will be disclosed where legally required or relevant to an informed business decision.

TKC does not sell client CRM contact lists or employee assessment records to unrelated businesses for their independent marketing.

Mobile information, text messaging opt in data, and related consent records will not be shared with third parties or affiliates for their independent marketing or promotional purposes. Authorized service providers may process such information as necessary to deliver requested messaging services.

08Service Providers and Subprocessors

Our services may depend on external providers of cloud infrastructure, CRM software, communications, hosting, payment processing, AI technology, assessments, analytics, and other operational capabilities. These providers may process information only as permitted by their applicable contractual arrangements and governing law.

For client controlled information, additional processing terms may be established in a Data Processing Agreement. A list or description of material subprocessors may be made available to contracted clients as required by applicable agreements.

09Client Data and Individual Access

Client businesses retain their rights in information they provide to TKC. TKC generally processes client controlled personal information to carry out the client's authorized instructions.

Employee access to assessments, training records, private reflections, manager feedback, and coaching materials depends on the program's documented permissions and applicable law. We seek to avoid unnecessary disclosure of private reflections or individualized assessment information when a less intrusive summary will satisfy the legitimate business purpose.

A private digital space does not necessarily prevent access by authorized system administrators or other individuals disclosed in the applicable program notice.

10Marketing Communications

TKC may communicate about its own services, events, educational resources, and related business opportunities where permitted by law. Marketing emails include applicable identification and unsubscribe mechanisms.

SMS and automated telephone communications are conducted subject to applicable consent requirements and messaging rules. Where required, individuals may withdraw consent or opt out through disclosed methods. Consent to marketing messages is not a condition of purchasing TKC services.

11Cookies and Analytics

Our websites may use cookies, analytics technologies, and similar mechanisms for essential website functionality, measurement, personalization, and other disclosed purposes. The specific technologies deployed may change.

Where applicable law requires consent or an opt out mechanism for particular tracking activities, we will provide appropriate choices. Users may also control certain cookies through their browsers.

12Security

TKC maintains a risk based information security program intended to protect the confidentiality, integrity, and availability of information. Safeguards may include access restrictions, multifactor authentication, appropriate encryption, personnel confidentiality obligations, vendor oversight, monitoring, and incident response procedures.

Security controls are selected according to applicable risks, technical capabilities, and contractual commitments. No system can guarantee absolute security.

13Security Incidents

We maintain processes to investigate suspected unauthorized access, disclosure, or loss of protected information. Where a reportable incident occurs, TKC will provide notifications required by applicable law and contractual obligations.

For information processed on behalf of a client, TKC will notify the client according to applicable data processing agreements and legal requirements.

14Retention and Deletion

We retain information only for the period reasonably necessary to satisfy authorized business purposes, contractual requirements, security needs, and applicable law.

Different retention periods may apply to contact information, financial records, assessment reports, coaching records, communication logs, and client CRM data. Client agreements may establish specific return, export, deletion, and transition procedures.

Backup records may remain temporarily subject to technical deletion schedules and applicable safeguards.

15Privacy Rights and Requests

Depending on the applicable jurisdiction, individuals may have rights to access, correct, delete, obtain, or restrict certain personal information, or to opt out of specified processing activities. Requests may be subject to identity verification and lawful exceptions.

Where TKC acts as a processor for a client, requests may be directed to that client. TKC will respond within legally applicable deadlines.

16Other States and International Information

Although TKC primarily operates in the United States, applicable privacy protections may depend on the residence of an individual, the nature of processing, and the jurisdictions in which services are provided. Where additional state, federal, or international requirements apply, those requirements will be addressed through applicable notices, agreements, and operational controls.

17Children's Information

TKC's direct business services are intended primarily for organizations and adult professionals. Our websites are not directed to children under 13, and we do not knowingly collect their personal information through our direct business marketing activities.

18Governing Law and Dispute Resolution

TKC is headquartered in Ohio, United States of America.

To the extent a dispute concerning this Privacy Policy or TKC's privacy practices is governed by an enforceable agreement between the parties, the governing law, jurisdiction, and venue provisions of that agreement shall apply.

Unless an enforceable agreement expressly provides otherwise, TKC's interpretation and administration of this Privacy Policy will be governed by the laws of the State of Ohio, without regard to conflict of laws principles, except where mandatory applicable laws require otherwise.

To the fullest extent permitted by applicable law and any enforceable agreement, legal proceedings concerning TKC's privacy practices shall be brought exclusively in the state courts of competent jurisdiction located in Lucas County, Ohio, USA, or, where federal subject matter jurisdiction exists, the United States District Court for the Northern District of Ohio, Western Division, sitting in Toledo, Ohio, USA.

Nothing in this Privacy Policy creates consent to jurisdiction or venue where such consent has not otherwise been validly established. Nothing in this section limits nonwaivable privacy rights, statutory remedies, regulatory authority, or jurisdictional requirements imposed by applicable federal, state, or other controlling law.

19Changes to This Policy

We may update this Privacy Policy as our services, technologies, or legal obligations change. Material changes will be communicated where required by law. An updated effective date will be published when revisions are made.
